Patients in Ireland rightly expect a high standard of care when visiting their dentist. While modern dentistry is advanced and generally safe, medical procedures carry inherent risks. However, there is a distinct difference between a procedure that fails despite best efforts and one that fails due to substandard treatment. When a dentist fails to meet the accepted standard of care during root canal therapy, the consequences can be painful, expensive, and damaging to your long-term oral health. Michael Boylan LLP specialises in investigating these complex cases to determine if preventable errors caused your injury.

Understanding Root Canal Treatment and Failure

Root canal treatment is often a necessary procedure to preserve a natural tooth, but understanding why it happens and why it sometimes fails is the first step in addressing a potential claim.

What root canal treatment is intended to achieve

The primary goal of root canal treatment, medically known as endodontic treatment,is to save a tooth that has become badly decayed or infected. The procedure involves removing the damaged area of the tooth (the pulp), cleaning and disinfecting the inner channels, and then filling and sealing it. When performed correctly, this stops the infection from spreading and allows you to keep your natural tooth rather than having it extracted.

Complication vs. Negligence: Understanding the difference

It is important to understand that dental treatments are not guaranteed to succeed. A failed root canal does not automatically mean your dentist was negligent. To pursue a legal case, we must distinguish between an unfortunate outcome and a failure in the standard of care.

  • Accepted risks: These are complications that can occur even when the dentist performs the procedure perfectly. For example, some teeth have complex, curved roots that are difficult to clean, or a tooth may simply fail to heal due to the body’s natural response.
  • Substandard care: This refers to errors that a competent dentist should not have made. This might include failing to use widely accepted techniques, ignoring clear signs of infection, or using the wrong equipment.

Determining this difference usually requires an independent expert opinion to review your dental records and X-rays.

Where root canal treatment errors can occur

Negligence in endodontics is not limited to the moment the dentist is drilling. Failures can occur at the diagnosis stage, during the procedure itself, or in the aftercare provided once the treatment is finished.

Assessment and diagnosis failures

Before any instrument touches your tooth, your dentist must confirm that the treatment is actually necessary and viable. Errors here can lead to painful, unnecessary work.

  • Treating the wrong tooth: Failing to identify exactly which tooth is causing the pain.
  • Missing an infection on an X-ray: Failing to spot decay or abscesses that should have been obvious to a competent professional.
  • Attempting the impossible: Starting a root canal on a tooth that has insufficient bone support or is too damaged to be saved, leading to inevitable extraction later.

Informed consent gaps

You have a right to know what is happening to your body. A dentist must obtain your informed consent before proceeding. This means they must clearly explain the material risks involved in the procedure and any valid alternatives, such as extraction or implants. Crucially, if a case is particularly difficult, a general dentist has a duty to offer a referral to a specialist endodontist. If they attempt a complex procedure beyond their skill level without offering you a specialist option, this may be considered a breach of duty.

Technical errors during the procedure

The root canal procedure requires precision. If the dentist rushes or lacks the necessary skill, specific technical failures can occur that compromise the tooth.

  • Missed canals: Teeth often have multiple tiny channels. If the dentist fails to find and clean all of them, infection will remain and likely return.
  • Perforation: This occurs when a dentist accidentally punctures the side of the tooth root or the floor of the tooth, creating a hole that allows bacteria to enter the surrounding bone.
  • Instrument separation: Small metal files are used to clean the canals. If a file breaks off inside the tooth and the dentist fails to remove it or fails to inform you so it can be managed, it can block proper cleaning.
  • Inadequate cleaning: Failing to flush out bacteria or filling the canal too short (or too long) can prevent the tooth from healing properly.

Restoration and aftercare issues

The treatment is not finished until the tooth is permanently sealed. Errors in this final stage are a common cause of failure.

  • Delays in sealing the tooth: If a permanent filling or crown is not placed promptly, bacteria can leak back into the root system, reinfecting the tooth.
  • Missed signs of failure: During follow-up appointments, a dentist should spot if the bone is not healing or if infection persists. Dismissing your complaints of pain is a serious oversight.

Signs that warrant a second opinion

If you have recently had a root canal and "something doesn't feel right," you should trust your instincts. While some tenderness is normal immediately after treatment, long-term issues are not.

  • Physical symptoms to watch for: Your body will often signal that the infection has not been resolved.
    • Persistent pain or swelling that continues long after the expected recovery period.
    • Recurring abscesses or the appearance of a "gum boil" (a small pimple on the gum).
    • A bad taste or smell coming from the specific area, which may indicate leaking fluid or infection.
  • Functional and structural warning signs: Sometimes the issue is mechanical rather than just painful.
  • The tooth cracking or fracturing shortly after treatment, often because it was not properly protected with a crown.
  • Inability to chew on that side of the mouth weeks or months after the procedure was finished.

The impact of a failed root canal

The consequences of dental negligence are rarely limited to "just a toothache." The impact can be systemic and disruptive to your daily life.

  • Physical and functional consequences:
    • Spread of infection: An untreated infection can spread to the jawbone or nearby teeth.
    • Bone loss: Chronic infection can erode the bone supporting your teeth.
    • Loss of the tooth: The ultimate failure often results in extraction, requiring expensive replacements like dental implants or bridges.
  • Psychological and financial impact:
    • Dental anxiety: A traumatic experience can make patients fearful of visiting a dentist again, leading to further oral health decline.
    • Cost of retreatment: Specialist endodontic retreatment or implants are significantly more expensive than the initial procedure.
    • Time off work: Managing chronic pain and attending multiple corrective appointments often results in lost earnings.

Evidence in a root canal negligence case

To succeed in a dental negligence claim, we must build a robust case based on facts and clinical evidence. We gather the following to support your claim:

  • Dental records: Your complete clinical notes and history from the treating dentist.
  • Radiographs: The pre-operative and post-operative X-rays are critical for showing the state of the tooth before and after the errors occurred.
  • Expert reports: We commission reports from independent dental specialists who can objectively confirm if the care you received fell below the acceptable standard.
  • Patient timeline: Your own record of symptoms, dates of appointments, and conversations with the dentist.

Complaint route

Litigation is not always the first or only step. Depending on the severity of the issue, there are other avenues for resolving disputes.

If you are dissatisfied with the service or costs, you may contact the Dental Complaints Resolution Service. They offer a mediation service to help resolve disputes between patients and dentists. For serious issues regarding professional misconduct or fitness to practise, a complaint can be made to the Dental Council of Ireland, though they do not award compensation.

Time limits for dental negligence claims in Ireland

In Ireland, strict time limits apply to legal action. Generally, you have two years to issue legal proceedings.

However, in dental cases, the clock does not necessarily start on the day the treatment was performed. It starts from the date of knowledge, the date you first realised (or should have reasonably realised) that your injury was caused by the treatment. For example, if a file was broken inside your tooth in 2021, but you only discovered it via an X-ray in 2024, the two-year limit may start from the 2024 discovery date. Determining this date can be legally complex, so immediate advice is recommended.

FAQs

Can a root canal fail even if the dentist did everything right?

Yes. Root canal treatment has a high success rate, but it is not 100%. If the failure is due to biology or complex anatomy rather than dentist error, it is considered a complication, not negligence.

What if I only discovered the problem years later?

You may still be able to make a claim. The two-year time limit usually begins from the date of knowledge, the moment you became aware that the treatment caused your injury.

Do I need to finish corrective treatment before speaking to a solicitor?

No. In fact, it is often helpful to speak to us early. However, you should never delay necessary medical or dental treatment. Your health is the priority. We can request records while your corrective treatment is ongoing.

What if the treatment was done outside of Ireland?

If you received dental treatment abroad (dental tourism), pursuing a claim can be more complex due to jurisdiction issues. We can advise you on whether a claim can be brought in Ireland during an initial consultation.
