It was our position that excessive force was used during the biopsy, resulting in a fracture of our client's pelvis. Following the procedure she developed urge incontinence as a result of the fractured sacral ala. She had not had any incontinence or other urinary difficulties before the pelvic fracture, and in our view her condition was the result of nerve damage associated with the fracture caused by the biopsy.

The defendant denied that excessive force had been used. It was admitted that our client suffered a fracture of the right sacral ala, but the defendant maintained that this is a rare, recognised complication of the procedure.

Our client continues to suffer from constant nerve pain and urinary incontinence and has been unable to return to work as a result.

The action settled for €475,000 plus all legal costs immediately prior to the hearing date.
